Diane Cairney

Diane is the Head of the Dispute Resolution/Litigation team and has over 30 years’ experience in this field. Diane has spent most of her career with the firm, having joined as a trainee in 1991, followed by a short spell with Hill Brown solicitors, before being appointed as a Partner at Miller Samuel LLP in 1999. She was the firm’s first full-time Managing Partner.

She frequently appears in the Sheriff Courts and the Lands Tribunal Scotland, and runs cases regularly in the Court of Session. She also has experience with Supreme Court proceedings.

She has extensive experience of handling a broad range of highly technical and complex cases, including:

  • Construction disputes
  • Procurement challenges
  • Commercial landlord/tenant disputes, including dilapidation claims
  • Various property disputes, including boundary disputes
  • Enforcing and defending breach of post-termination restrictions (restrictive covenants)
  • Company disputes, including director and shareholder disputes
  • Debt recovery cases
  • Insolvency proceedings
  • Professional negligence claims
  • Breach of contract
  • Equestrian disputes
  • Clinical negligence & high value injury claims

She previously served as a council member of the Royal Faculty of Procurators in Glasgow and was also a tutor for the postgraduate diploma at the University of Glasgow School of Law.
