Judicial review into Children and Young People Bill

The Scottish Government could be facing a legal challenge over a provision contained within the recently passed Children and Young People (Scotland) Bill, reports the Scotsman.

Religious group, the Christian Institute, has objected to provisions contained within Section 4 of the Bill, which seeks to improve the advice and help available when needed for children and families from early years to adulthood. To do this, the Bill says that every child in Scotland should be given a “named person” – usually their health visitor or head/senior teacher – who will be available as a single point of contact.

The Christian Institute believes that this provision is a breach of human rights legislation as the powers given to this “named person” will interfere with parent’s right to a private and family life.

The Institute is therefore seeking a judicial review of Section 4 of the Act, and has asked the Scottish Government not to enact the Bill until the case can be heard.
