UK Supreme Court Rules Employment Tribunal Fees Unlawful

The UK Supreme Court has ruled that Employment Tribunal fees are unlawful since they have the effect of preventing access to justice for claimants. Wednesday’s decision comes following the case brought by UNISON against the government. Having been unsuccessful in their previous challenges in the High Court and the Court of Appeal, the UK Supreme Court have unanimously agreed that the fees scheme imposed is unlawful.

Father Wins Sex Discrimination Case – Shared Parental Leave

 Shared Parental Leave (“SPL”) is a fairly recent addition to the world of employment law. SPL came into force in April 2015 and provided parents with a more flexible way to take leave from employment in the first year after the birth of a child, or the placement of a child with them for adoption. The SPL legislation allows a mother to convert part of her maternity leave (except from the compulsory 2 weeks immediately following the birth of a child) to SPL, which can then be used by her partner, usually the mother’s husband or civil partner or the child’s father.

The Taylor ‘Good Work’ Review – Recommendations for the Changing Labour Market

The Taylor Review, now named the ‘Good Work’ Review, was published earlier this month. This review involved a review of the state of the current labour market in the UK and examined how new models of working have affected the freedom and rights of workers. Launched at the end of 2016, the review’s overriding ambition is that all work in the UK economy is fair and decent with a realistic scope for all workers of development and fulfilment. To this end, the review has made a number of recommendations for the Government to consider when examining the current legislative framework in the coming years.

TUPE and Pre Pack Sales in Administration

The Court of Justice of the European Union (CJEU) has this week made a decision which confirms that the Transfer of Undertakings (Protection of Employment) Regulations 2006 (“TUPE”) will apply to transfer employees where a business in administration is subject to a pre pack sale. This reflects a similar decision made previously by UK courts and tends to confirm the position regarding businesses in administration (as opposed to some other form of insolvency procedure) and pre pack sales in particular.
